Frequently Asked Estate Planning Questions
How long does it take to create an estate plan, and what's involved?
A basic estate plan typically takes two to three weeks from initial consultation to final signing. The process includes a free consultation, document preparation, a review meeting, and final signing. We handle all documentation and guide you through each step to ensure your plan reflects your wishes.
What happens if I don't have a plan when I become incapacitated?
Without an estate plan, the court will appoint a conservator to manage your affairs if you become incapacitated. This can be time consuming, expensive, and may not reflect your wishes. A proper plan with advance directives and powers of attorney lets your chosen representatives make medical and financial decisions on your behalf without court oversight and expense.
Do I need a trust if I already have a will?
While a will is important, a trust offers significant advantages including avoiding probate, maintaining privacy, and providing more control over asset distribution. A will does not avoid a Probate Proceeding when the estate exceeds California’s probate thresholds. As of April 1, 2025, those thresholds are $208,850 for personal property (e.g., cash and investment accounts) and $69,625 for real property. A simplified process is also available for a primary residence valued up to $750,000. Keep in mind these thresholds apply to gross value, not equity after mortgages and debts, so many California homeowners exceed them without realizing it.
