Why Estate Planning is Essential

An effective Estate Plan answers critical questions about your property and assets, ensuring peace of mind for you and your loved ones. Here are some key considerations:

  • What happens to my property when I am alive and well?
  • What will happen to my property when I die?
  • What if I become unable to make decisions for myself?
  • What property will go to my spouse and children?
  • When should my property go to my heirs?
  • What if my spouse or children do not survive me?
  • Who will manage my property during my lifetime and after my death?
  • Will my estate require court oversight or probate?
  • What happens to assets not included in the Trust?

At David R. Schneider, APC, we address these questions and more, providing you with a comprehensive estate plan tailored to your unique needs.

What Our Clients Say About Working with David

Frequently Asked Estate Planning Questions

How long does it take to create an estate plan, and what’s involved in the process?

A basic estate plan typically takes 2-3 weeks to complete from initial consultation to final document signing. The process includes an initial free consultation, document preparation, review meeting, and final signing. We handle all documentation and guide you through each step to ensure your plan reflects your wishes.

What happens if I don’t have an estate plan when I become incapacitated?

Without an estate plan, the court will appoint a conservator to manage your affairs if you become incapacitated. This can be time-consuming, expensive, and may not reflect your wishes. Having a proper estate plan with advance directives and powers of attorney ensures your chosen representatives can make medical and financial decisions on your behalf without the need for court oversight and expense.

Do I need a trust if I already have a will?

While a will is important, a trust offers significant advantages including avoiding probate, maintaining privacy, and providing more control over asset distribution. A trust can help reduce estate taxes, protect assets, and ensure smooth transfer of property to beneficiaries without court intervention. Wills do not avoid probate proceedings where the estate is larger than the probate thresholds set by the state. In CA the threshold is value (not equity) greater than $61,500 for real estate and $184,500 for personal property e.g., cash/investment accounts.

What’s the difference between a free consultation and a paid estate planning session?

The free consultation is an introductory meeting allowing you to meet with the attorney to discuss your needs and outline potential solutions. During this meeting, we review your situation and explain our services. Paid sessions involve detailed planning, document preparation, and implementation of your estate plan based on your specific circumstances and goals.
